Third-Party Funding in International Arbitration

16 January 2025
Half-day training session organised by the OIC-AC

The Organisation of Islamic Cooperation Arbitration Centre (OIC-AC) warmly invites in-person and virtual participants to an enriching half-day training session on Third-Party Funding in International Arbitration, an increasingly crucial topic in the field.

The OIC-AC’s inaugural training session will be of particular value to lawyers, arbitrators and other ADR professionals, Islamic finance practitioners and academics, and representatives from related institutions. That said, anyone with a keen interest in how international arbitration, Islamic finance, and third-party funding intersect will benefit from the half-day’s three expert sessions:

Session 1 (09:40-10:30)

Essentials, Governing Principles, and Impacts of Third-Party Funding

Mahnaz Malik is an international arbitrator, barrister, and author. In the first of our training day’s three sessions, she will discuss the key aspects and governing principles of third-party funding in international arbitration, considering also the various impacts third-party funding has on parties, party representatives, and arbitrators.

Session 2 (10:45-11:35)

The Funder’s Perspective: Overview of the Third-Party Funding Market

Dr. Hasan Tahsin Azizağaoğlu oversees several aspects to the third-party funding process at Bench Walk Advisors, serving also as the co-chair of the Third-Party Funding Group at the Chartered Institute of Arbitrators. Drawing on such experience, his session will address key criteria considered by funders, how to select appropriate funders, and what funding options are available.

Session 3 (11:50-12:40)

Third-Party Funding Within the Islamic Framework

Dr. Can Eken has recently published Third-Party Funding in Investment Arbitration: A New Player in the System (Springer, 2024) and has also written specifically on third-party funding within the Islamic framework. He will extend his expertise in these domains to deliver the day’s third session, covering the compatibility of third-party funding to schools of Sharia law and Shia doctrines, as well as the operational mechanisms of third-party funding arrangements and their significance for lawyers on transactions within OIC member countries.

Coffee breaks between each session will offer participants the chance to network with like minds. In this regard, we envision the session as a stepping stone to fruitful and long-term relationships within and across the ADR and Islamic Finance communities.
